  1. Introduction

    Before you start using our SAAS (Software as a Service) platform, we kindly request that you carefully review our Terms of Use, and Privacy Policy. Welcome to ConversaLink ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of our platform and services. By accessing or using our platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

  2. Acceptance of Terms

    By accessing or using our platform, you explicitly agree to these Terms. If you do not agree with any part of these Terms, you must refrain from using our services.

  3. Description of the service

    Our service provides a chatbot with AI capabilities that leverage user-provided data from their Airbnb apartments to enhance communication with guests. Our features include: booking availability management, conversation context, high-quality support, simplified communication, and detailed analytics.

    • Audio recognition.
    • Airbnb apartment synchronization.
    • You will have full control over the chatbot, allowing you to supervise the messages between your customers and the chatbot through a dashboard.
    • Chart of your customers' bookings in a month through a dashboard.
    • Image AI recognition.
    • Booking availability management.
    • Conversation context.
    • High-quality support.
    • Simplified communication
  4. Registration and User Accounts

    To access to the features of our platform, you are required to create an account. You are responsible for maintaining the confidentiality of your account credentials.

  5. Acceptable Use

    You agree not to use ConversaLink to:

    • Transmit any content that infringes or violates the intellectual property rights or any other rights of anyone else.
    • Distribute legally protected content without proper authorization.
    • Transmit any material that contains viruses, trojan horses, worms, time bombs, cancelbots or any other malicious or harmful programs.
    • Interfere with, disrupt, negatively affect or inhibit other users from fully enjoying ConversaLink.
    • Transmit any unsolicited or unauthorized advertising, solicitations, promotional materials, spam, junk mail, chain letters, pyramid schemes or any other form of solicitation.
    • Transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
    • Bypass any robot exclusion headers or other measures ConversaLink employs to restrict access to the services.
    • Harvest, collect or gather user data without their consent.
    • Circumvent any IP address blacklists, filters or other measures meant to restrict access to ConversaLink's services.

    You agree you must evaluate and bear all risks associated with the use of any content accessed through ConversaLink, including any reliance on the accuracy, completeness, or usefulness of such content. You may not attempt to gain unauthorized access to ConversaLink or any systems or networks connected to ConversaLink's services.

  6. Intellectual Property

    ConversaLink and its services, including all content, software, functions and artwork, are owned and operated by ConversaLink S.L. ConversaLink contains proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright and trademark laws.

    You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display, publicly perform, republish, download, store or transmit any of the material obtained through ConversaLink, except as follows:

    • Your content: You retain any intellectual property rights you already hold in content you upload or transmit through ConversaLink.
    • Open source: You may use code labeled as open source under the terms of the specific open source license.
    • With consent: You may use content from ConversaLink with prior written consent from ConversaLink S.L.

    The ConversaLink name, logo, and any other trademarks displayed on the services are owned by ConversaLink S.L and may not be used without prior written consent. You may not imply any endorsement by or affiliation with ConversaLink without prior written consent.

    If you violate any terms contained in this Intellectual Property section, your permission to access and use ConversaLink will terminate immediately.

  7. Payment Terms

    Use of the ConversaLink chatbot service requires a recurring payment. Payment must be made via credit or debit card through our payment processor Stripe.

    All fees are displayed prior to signing up for the ConversaLink service. By providing your payment information, you authorize ConversaLink to charge your payment method for the total amount displayed.

    Payment is non-refundable, except in cases where:

    • The payment was charged without your authorization;
    • The payment amount charged was incorrect;
    • You requested cancellation within 14 days of initial payment.

    Refunds will be processed within 30 days of a verified refund request. All payments are handled by Stripe. ConversaLink does not store any credit card or banking information.

    You are responsible for any taxes that may apply to your payment, if any. ConversaLink's services are provided without VAT/GST as per European Union rules.

    ConversaLink reserves the right to adjust pricing for its services. Any pricing changes will not affect active accounts, and will take effect for new signups after at least 30 days' notice.

  8. Cancellation and Account Termination

    You may cancel your ConversaLink account at any time by contacting us. Cancellation requests received within 14 days of initial payment are eligible for a full refund.

    Upon cancellation, your license to access ConversaLink will immediately terminate. Any content you have stored in ConversaLink may be permanently deleted.

    ConversaLink reserves the right to suspend or terminate your access to the ConversaLink service at any time for any breach of these Terms of Use or if your use violates any law, regulation or public policy. Such termination may involve deletion of any content stored in your ConversaLink account.

    Accounts that are unpaid or inactive for an extended period may also be terminated as deemed necessary by ConversaLink.

    If ConversaLink discontinues the ConversaLink service, all accounts will be terminated. ConversaLink will provide at least 30 days advance notice before discontinuing service.

    Any payment obligations and provisions that by their nature should survive cancellation of your account will remain in effect.

  9. Limitation of Liability

    In no event shall ConversaLink, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

    ConversaLink accepts no liability for any damage caused by security breaches, technical failures, or force majeure events that are beyond its reasonable control. We do not warrant that the Service will be available at all times, uninterrupted, secure, or error free.

    In the event ConversaLink is found liable for any damages related to your use of the Service, in no event shall the total cumulative liability exceed any fees paid by you during the six (6) months prior to the event giving rise to the liability.

    Certain jurisdictions do not allow limitations of exclusion of certain warranties or damages, so some of the above limitations may not apply to you. However, in such cases, the remaining provisions will continue in full effect.

  10. Applicable Law and Dispute Resolution

    These Terms shall be governed by the laws of the European Union, without regard to conflict of law principles.

    For any dispute arising out of or relating to these Terms or the Service provided by ConversaLink, you agree to first contact ConversaLink and attempt to resolve the dispute informally. We will make reasonable efforts to reach a mutually agreeable resolution.

    If informal efforts do not resolve the dispute, you and ConversaLink agree to resolve any claim, dispute, or controversy arising out of or in connection with these Terms by binding arbitration. The arbitration will be conducted by the European Court of Arbitration in accordance with its rules and procedures. Judgment on the award rendered may be entered in any court with jurisdiction.

    Any arbitration will take place in Madrid, Spain, and you hereby irrevocably consent to the jurisdiction of and venue in the courts in Madrid for any disputes arising out of these Terms.

    You acknowledge and agree that you and ConversaLink are each waiving the right to a trial by jury or to participate in a class action.

    Despite the above, ConversaLink may seek injunctive relief regarding any violation of intellectual property rights or confidentiality obligations in any appropriate jurisdiction.

  11. Changes to the Terms

    ConversaLink reserves the right to modify these Terms of Use at any time and in our sole discretion. If we make material changes to these Terms, we will notify you via email or by posting a notice on our website prior to the changes taking effect. Your continued use of the Service after the changes have been made will constitute your acceptance of the revised Terms.

    For any material changes, you will have the right to terminate your use of ConversaLink prior to the changes taking effect. Changes will not apply retroactively to conduct that occurred prior to the changes taking effect. If you do not agree with the modifications, you should discontinue using the Service.

    The most current version of these Terms will be located in the bottom of the page. We advise that you re-read these terms on a regular basis.

    Non-material changes or clarifications will take effect without notice. We encourage you to check back regularly for updates.

    ConversaLink utilizes the WhatsApp Cloud API provided by Meta Platforms, Inc. for integration with WhatsApp. Usage of the WhatsApp Cloud API is governed by the WhatsApp Terms of Service.

    ConversaLink requests access to the following features of the WhatsApp Cloud API:

    • whatsapp_business_management - Allows the application to read or manage the business assets of WhatsApp that are either owned by you or to which other companies have granted you access. Business assets include WhatsApp business accounts, phone numbers, message templates, QR codes and their associated messages, and subscriptions to webhooks.
    • whatsapp_business_messaging - Allows an application to send WhatsApp messages to a specific phone number, upload and retrieve multimedia content from messages, manage and obtain information from the WhatsApp Business profile, and register such phone numbers with Meta.
